General Terms and Conditions
§ 1 SCOPE OF APPLICATION
The following terms and conditions form the basis and integral part of all contractual relationships and related legal transactions between Sebastian Sittig | media ivent Veranstaltungstechnik, Rudolf-Breitscheid-Str. 162, 14482 Potsdam, and its contractual partners who make use of goods and services provided by Sebastian Sittig | media ivent Veranstaltungstechnik (hereinafter referred to as the “Renter”). By using our rental items or placing an order, the following terms are accepted. Any general terms and conditions of the Renter are hereby expressly rejected.
§ 2 OFFER AND CONCLUSION OF CONTRACT

Offers made by Sebastian Sittig | media ivent Veranstaltungstechnik are generally subject to change and non-binding. Orders placed by the Renter and order confirmations by Sebastian Sittig | media ivent Veranstaltungstechnik are only legally valid if made in written or telecommunication form (fax). If our offer is based on specifications provided by the Renter and these later prove to be incorrect, the Renter shall bear the costs of any additional work resulting from the changes. Any claims for damages remain unaffected.

The rental period begins on the day of collection and ends on the day the rented equipment is returned. A daily rental rate refers to a rental period of 24 hours. Any started day will be charged as a full day.
§ 3 WARRANTY AND LIABILITY
Sebastian Sittig | media ivent Veranstaltungstechnik undertakes to hand over the rental object in working condition and to make it available for the duration of the rental period. Handover takes place at the warehouse of Sebastian Sittig | media ivent Veranstaltungstechnik. Delivery can be arranged at additional cost. Sebastian Sittig | media ivent Veranstaltungstechnik is entitled, but not obligated, to maintain the rental object during the rental period.
§ 4 OBLIGATIONS OF THE RENTER

The Renter is obliged to check the completeness and proper functioning of the rented equipment upon receipt or before shipment. Acceptance shall be deemed confirmation that the equipment is in proper condition and complete.

The rental object must be handled with care and may only be set up, operated, and dismantled by qualified personnel. Improper use entitles Sebastian Sittig | media ivent Veranstaltungstechnik to terminate the rental agreement immediately without notice.

The Renter must ensure trouble-free use of the rented equipment. The Renter is liable for failures and damages to the rental items. If the rental object becomes unusable without fault on the part of the Renter, the Renter must notify Sebastian Sittig | media ivent Veranstaltungstechnik immediately. The Renter guarantees that the equipment will be returned in clean, proper condition and in an orderly manner. The Renter is liable for damages, loss, or similar up to the replacement value of the equipment.

The agreed rental period must be strictly adhered to; if this is not possible, Sebastian Sittig | media ivent Veranstaltungstechnik must be informed immediately. For each day the return deadline is exceeded, the full agreed daily rate must be paid. In addition, the Renter must compensate Sebastian Sittig | media ivent Veranstaltungstechnik for any demonstrable damages caused by the delay.
§ 5 WARRANTY CLAIMS OF THE RENTER
Warranty claims require that the Renter has checked the completeness and functionality of the rental object upon receipt in accordance with § 4 (1) and that any defect is reported immediately after discovery. In the event of a defect, Sebastian Sittig | media ivent Veranstaltungstechnik may choose to replace or repair the item. If replacement or repair cannot be carried out in time, the Renter may withdraw from the contract or request an appropriate reduction of the rental price. Any further warranty claims are excluded.
§ 6 SUBLETTING / TRANSFER
Subletting or transferring the equipment from the Renter’s possession is only permitted with our explicit consent. If subletting or unauthorized transfer to third parties occurs without approval, Sebastian Sittig | media ivent Veranstaltungstechnik is entitled to terminate the rental agreement without notice.
§ 7 EVENTS
If it is agreed that Sebastian Sittig | media ivent Veranstaltungstechnik will supervise the operation of the rental equipment during an event, the company shall have the necessary rights, in particular:

to switch off or dismantle the equipment if there is a risk to the physical safety of persons present or if, in the case of open-air events, weather conditions endanger the equipment.

to switch off the equipment in case of disturbances or unrest that endanger it. If the equipment is switched off or dismantled under such or similar circumstances, the Renter is not entitled to any claims for damages.

our sound systems may produce sound levels that can cause hearing damage. According to DIN 15905 Part 5, the event organizer is responsible for monitoring sound levels, preventing limit exceedance, and documenting measurements.
§ 8 DAMAGES

The exclusion of liability also applies to claims for damages by the Renter, including those arising from impossibility of performance, non-performance, breach of contract, or tort. The exclusion applies to all types of consequential damages, except where damage is caused by gross negligence or intentional misconduct by Sebastian Sittig | media ivent Veranstaltungstechnik, or in cases of expressly warranted characteristics in writing. Where liability is excluded, this also applies to the personal liability of employees.

When renting technically complex equipment (e.g., video projectors, media servers, computer-controlled lighting) without specialist personnel from Sebastian Sittig | media ivent Veranstaltungstechnik, no liability is assumed for proper functioning. The Renter bears the burden of proof for the cause and amount of damage.

If equipment is rented without personnel, the Renter must comply with all applicable safety regulations, particularly UVV and VDE standards. Equipment must only be used as intended. In case of uncertainty, a qualified expert must be consulted. Otherwise, the liability limitations in § 5 apply.
§ 9 INSURANCE
The Renter is obliged to adequately insure the risks associated with the rental object. Proof of insurance must be provided upon request. Upon explicit request, Sebastian Sittig | media ivent Veranstaltungstechnik can arrange insurance at additional cost (shown separately in the offer).
§ 10 PRICES / PAYMENTS / CANCELLATION

Prices and payment terms are agreed individually for each transaction. Sebastian Sittig | media ivent Veranstaltungstechnik reserves the right to change its price list at any time without prior notice.

Cancellation of a confirmed order is free of charge up to 90 days before the start of setup or collection, unless otherwise agreed. After that, the following cancellation fees apply (percentage of net order value):

up to 80 days before start: 30%

up to 60 days before start: 50%

up to 30 days before start: 70%
-
up to 7 days before start: 100%
We reserve the right to invoice the corresponding cancellation fee. Cancellation must be made in writing to: welcome@media-ivent.com

The Renter may only offset claims or exercise a right of retention if these are undisputed or legally established.
§ 11 RETENTION OF TITLE
Goods remain the property of Sebastian Sittig | media ivent Veranstaltungstechnik until full payment has been made. Rental items remain the property of Sebastian Sittig | media ivent Veranstaltungstechnik at all times.
§ 12 RIGHTS OF THIRD PARTIES
The Renter must keep the equipment free from third-party claims, liens, or encumbrances. If the equipment is seized or claimed by third parties during the rental period, the Renter must inform the lessor immediately and provide all necessary documents. The Renter shall bear the costs required to remove such third-party interventions.
§ 13 FINAL PROVISIONS
These terms and all legal relations between Sebastian Sittig | media ivent Veranstaltungstechnik and the Renter are governed by the laws of the Federal Republic of Germany. The contract language is German.

Place of performance and jurisdiction for all disputes is Berlin. However, we are also entitled to bring legal action at the Renter’s place of business.

Should any provision of these terms be or become invalid, the validity of the remaining provisions shall not be affected. The parties undertake to replace the invalid provision with a valid one that most closely reflects the original intent.

No verbal side agreements exist. Amendments must be made in writing to be effective.

It is noted that data exchanged within the contractual relationship will be processed in accordance with the German Federal Data Protection Act.
All prices of Sebastian Sittig | media ivent Veranstaltungstechnik are in EURO. Subject to price changes, printing errors, and mistakes.
